1. Subject

1.1. The purpose of these General Terms and Conditions of Sale (hereinafter, “General Terms and Conditions”) is to regulate the purchase of “DIGUE NATURAL BEAUTY” products, made remotely, via computer network, from the Site www.diguebeauty.com.

1.2. The owner of the Site is REVOLUNION SRL with registered office in Via Raffaello Sanzio 13w – 20060 Trezzano Rosa, Tax Code and VAT no. 12673830969.

1.3 In order to proceed with the purchase of Products through the Site, the Customer must be at least eighteen years of age or, if a minor, must be duly authorized by his or her parents or otherwise by a person exercising parental authority. In addition, the Customer declares that he/she is a “consumer” as defined in the Italian Consumer Code (Legislative Decree no. 206/2005), that he/she is a natural person and that the Products will be intended only for strictly personal use and that the purchase of the same is not made in the course of his/her professional activity.

2. Acceptance of general terms and conditions

2.1. All purchases of Products made through the Site by users who access it (the “Customer” or the “Customers”) are governed by these General Conditions as well as by the Italian Consumer Code (Legislative Decree no. 206/2005), Section II Distance Contracts (Articles 50 – 67) and by the Italian regulations on electronic commerce (Legislative Decree 70/2003).

2.2. By entering into Purchase Contracts, the Customer accepts and agrees to abide by these General Terms and Conditions.

2.3. The Customer, therefore, is required to read carefully, before making any purchase transaction, these General Conditions that REVOLUNION SRL makes available to him also in order to allow him to reproduce and store in compliance with the provisions of Art. 12, 3rd paragraph of Leg. 70/2003.

2.4. REVOLUNION SRL may change, at any time and without notice, the contents of the General Conditions. The General Terms and Conditions published on the Site at the time of the conclusion of the Purchase Agreement by the Customer will apply to each individual Purchase Agreement.

3. Products

3.1. The Site is a computerized tool for the sale of cosmetics, body care beauty products, make-up and related accessories in general under the exclusive brand name DIGUE NATURAL BEAUTY (the “Products”).

3.2. All Products offered are detailed on the Site, within their respective sections, separated by Product categories.

3.3. The visual representation of the Products on the Site, where available, has an indicative value and normally corresponds to the photographic image of the Products themselves and has the sole purpose of presenting them for sale, without any guarantee or commitment, on the part of REVOLUNION SRL, as to the exact correspondence of the image depicted on the Site with the actual Product; and this, with particular regard to its actual dimensions and/or the chromatic aspects of the Products and/or packaging.

3.4. In case of any difference between the image on the Site and the relevant product sheet, the description in the product sheet shall always prevail.

4. Purchasing procedure

4.1. The Customer may purchase Products in the DIGUE NATURAL BEAUTY electronic catalog by complying with the technical access procedures outlined therein.

4.2. To purchase Products through the Site, the Customer must proceed to register on the Site by entering his/her personal details, following the instructions provided by the registration program. If the Customer is already registered, he/she will need to authenticate on the Site by entering his/her credentials created during the registration phase. The Customer must complete the order form available on the Site, following the instructions therein. Purchase orders must be exactly filled out in every part. In the event that the Customer does not wish to register on the Site, he/she may still complete the purchase process, but will not be able to take advantage of discounts and promotions reserved for registered users.

4.3. The Customer must place the selected Products in the appropriate “Shopping Cart” and, after choosing the carrier and viewing and accepting the estimated contribution for delivery costs, may proceed with the purchase.

4.4. If the Customer needs to change the type and/or quantity of Products in the Shopping Cart, he/she must use the appropriate controls in the “Shopping Cart section” of the Site and/or App.

4.5. After this operation is completed, the Customer will display a screen containing a summary of the purchase order, including delivery charges, with a request for further confirmation to the purchase procedure.

4.6. After viewing the summary, the Customer must select the desired type of payment, i.e. credit card, PayPal (and/or other means of payment that may be provided within the Site and/or App), or by Gift Card, and submit the order by clicking on the appropriate button.

5. Conclusion of the contract

5.1. The publication of the Products displayed on the Site constitutes an invitation to the Customer to make a contractual proposal to purchase. The order sent by the Customer has the value of a contractual proposal and implies full knowledge and acceptance of these General Conditions.

5.2. Each Purchase Agreement entered into between REVOLUNION SRL and the Customer shall be deemed concluded when the Customer views the Order Confirmation page of the Site, containing the “Order Number” and a summary of the order. The Customer will also receive an email to the email address entered during the conclusion of the order, containing the “Order Number” identifying the order itself, which must be used in any subsequent communication with REVOLUNION SRL, the information required by law, as well as all the data entered by the Customer. The Customer undertakes to verify the correctness of what is stated in the email and to promptly notify REVOLUNION SRL of any request for modification and/or correction with respect to such data. Possible aggravation of expenses brought about by errors in the indication of data by the Customer and not reported by him in a timely manner, will be placed at his sole expense.

5.3. Each order can be viewed by the Customer on the Site, in their personal area, if they are registered.

5.4. Occasional unavailability of the Products offered may occur, in which case, if the Products chosen by the Customer are, in whole or in part, unavailable, the order will be sent with the available Products after sending notice to the Customer about the unavailable Products.

5.5. REVOLUNION SRL has the right to accept or not, at its own discretion, the order sent by the Customer, without the latter being able to make claims or rights of any kind, for any reason whatsoever, including compensation, in the event of non-acceptance of the order.

5.6. In particular, REVOLUNION SRL reserves the right not to accept purchase proposals and cancel orders that do not give sufficient guarantees of solvency or if – even after comparison with the circuit that handles credit card payments; – anomalies are found in the transactions and means of payment used by the Customer.

5.7. The Customer may at any time verify the content of the concluded Purchase Agreements by accessing his/her personal area of the Site, if he/she is registered.

6. Product prices

All Product prices are clearly stated on the Site and are inclusive of VAT. Delivery charges are properly highlighted at the time of ordering. The cost of each shipment may vary depending on the delivery and payment method as well as the destination and total amount of the order.

7. Receipt and Payment Method

7.1. REVOLUNION SRL will issue a receipt for the purchased Products, at the time the Products are delivered to the courier for shipment, sending it by e-mail to the Customer. The information provided by the Customer is the basis for issuing the receipt. No changes in the data will be possible after the issuance of the receipt itself.

7.2. As more fully detailed below under the relevant points, Credit Card and PayPal payments require only an authorization or reservation of money without actual debit at the time the Customer enters the order. Therefore, payment is actually charged to the Customer only at the time the Products are delivered to the courier company assigned for shipment. At this stage REVOLUNION SRL will also issue the receipt for the order.

7.3. Payment for purchased Products shall be made by credit card, PayPal (and/or other means of payment that may be provided within the Site and/or App) Gift Card in the manner specified below.

Online credit cards
Accepted credit cards are listed on the website. All data are transferred in encrypted form using SSL certificates and are therefore not intercepted by external parties. In addition, data entry is done directly on the bank’s website, thus ensuring maximum security.

PayPal, an eBay group company, is a fast and secure payment system. Once the order is completed and PayPal is chosen as the payment method, the Customer will be redirected to the PayPal site, where he/she can access his/her account by entering his/her personal e-mail address and password. After registration, you can proceed with PayPal payments without having to re-enter your information, even for subsequent purchases. By choosing to pay with PayPal, the amount is charged directly to the assigned credit card (Visa, Visa Electron, Mastercard, American Express) or prepaid card (PostePay). PayPal protects Customer information in that no financial information is passed. A confirmation e-mail from PayPal will be sent with each transaction made by this method. It should be noted that the amount of the order is debited from the PayPal account when the courier takes the order. When placing an order on the Site and/or in the App, an authorization request will simply be made to verify availability on the Customer’s PayPal account, with no charge. If the order is cancelled, the amount is refunded to the Customer’s PayPal account.

Gift Card
The Customer may use a “Gift Card” for payment by selecting within the “Check out” section Gift Card as the method of payment if it is active and (after choosing the shipping method) entering their data in the manner specified on the site.

If it is active and communicated on the site as a possibility of purchase, the Customer may proceed with the payment of the Purchase Agreement through the portal “Scalapay” (owned by the company Scalapay S.r.l. based in Milan, Corso Italia 8, P.Iva 06891080480), which allows you to purchase Products up to a maximum of €300, paying in 3 installments without interest. If the Customer chooses this payment method, he/she will be redirected to the Scalapay portal where he/she will be asked to log into the Scalapay account to complete the payment process. In case the Customer does not have a Scalapay account, he/she may create one before the conclusion of the Purchase Agreement. Concurrently with the conclusion of the Purchase Agreement, the Customer will be charged by Scalapay the first installment equal to one-third of the total value of the Purchase Agreement itself. The next 2 (two) installments will be charged by Scalapay to the Customer each month. More information can be found in the dedicated section on the website.

8. Method and cost of delivery

8.1. REVOLUNION SRL agrees to deliver the Products without undue delay and no later than thirty days after the conclusion of the Purchase Agreement. Delivery of the Products will be made by courier, and the time will vary depending on the destination. However, the terms given at the time of the order are indicative.

8.2. In accordance with the provisions of EU Regulation 2018/302 it will also be possible for Customers who are citizens of the European Union but do not reside on Italian territory to purchase Products on the Site.

8.3. No liability, for any reason whatsoever, may be charged by the Customer to REVOLUNION SRL in the event of any delay in the processing of the order or delivery of the Products covered by the Purchase Agreements.

8.4. Ordered Products will be sent to the mailing address specified by the Customer. Upon delivery of the Products by REVOLUNION SRL to the assigned courier, an e-mail confirming the shipment will be sent to the Customer.

8.5. Deliveries of Products will be made from Monday to Friday, during normal business hours, excluding national holidays in the manner specified by the courier company chosen by the Customer. Delivery is considered completed when the Product is made available to the Customer at the address specified in the order form. In the event of non-delivery due to the absence of the recipient at the specified address, the courier will send a warning email and attempt a new delivery in the manner they have predetermined. If it is impossible to make the new delivery due to the absence of the recipient, REVOLUNION SRL Customer Service will attempt to contact the Customer to schedule an additional delivery. In the event that REVOLUNION SRL Customer Service fails to contact the Customer for the next 10 days or in the event of further impossibility of delivery due to the absence of the recipient, the Products subject to the order will be redelivered to REVOLUNION SRL. After 30 (thirty) days have elapsed from the date on which the Products object of the order have been sent back to REVOLUNION SRL due to the impossibility of executing the delivery, the relevant Purchase Agreement shall be considered terminated and the purchase order cancelled pursuant to art. 1456 c.c.. REVOLUNION SRL will proceed to reimburse the amount paid by the Customer net of the costs of returning the Products and the costs of their storage at the branch of the courier appointed for the delivery.

8.6. The termination of the Purchase Agreement and the amount of the refund will be communicated by e-mail to the Customer. The refund amount will be credited to the means of payment used by the Customer for the purchase. In the event that, before the elapse of thirty days, the Customer requests to receive the purchased Products again, REVOLUNION SRL will proceed with the new delivery upon charging, in addition to the costs of the same, the costs of returning the Products to REVOLUNION SRL and the costs of storage.

8.7. Upon delivery of the Products by the courier appointed by REVOLUNION SRL, the Customer is required to scrupulously check: a) that the anti-abrasion label is intact and the packaging is undamaged or otherwise altered; b) that the number of pieces being delivered corresponds to what is indicated in the transport document.

8.8. Any damage to the anti-abrasion label, packaging and Products or the mismatch in the number of pieces/packages or indications must be immediately contested by the Customer, who may contact REVOLUNION SRL through the methods indicated on the site specifying the order for which such misunderstandings occurred.

8.9. Cases of force majeure (such as, but not limited to, supervening provisions of laws, regulations and other measures of Public Authority, wars, embargoes, fires, floods, explosions, earthquakes, floods, epidemics, strikes, etc.), unavailability of means of transportation, as well as unforeseeable or unavoidable events that cause a delay in deliveries or make deliveries difficult or impossible or cause a significant increase in the cost of delivery to be borne by REVOLUNION SRL, shall entitle the same to split, postpone or cancel, in whole or in part, the scheduled delivery or to terminate the Purchase Agreement. In such cases, it will be the responsibility of REVOLUNION SRL to provide timely and adequate communication of its determinations to the e-mail address indicated by the Customer, and the latter will be entitled to a refund of any price already paid, excluding any further claim, for any reason whatsoever, against REVOLUNION SRL.

9. Discount Coupons – Promotions

9.1. Any discount coupons or promotional codes may be entered when the Customer fills out the purchase order within the “Shopping Cart section”. The system will update the total amount of the order less the value of the voucher.

9.2. The coupon may be combined with other commercial initiatives only in the cases where it will be expressly indicated.

10. Right of withdrawal and its effects

10.1. The Customer has the right to withdraw from the Purchase Agreement, without giving reasons, within 14 days.

10.2. The withdrawal period expires after 14 days from the day the Customer or a third party, other than the carrier and designated by the carrier, acquires physical possession of the Products. In the case of a Purchase Agreement for multiple Goods ordered in a single order and delivered separately, the 14-day period begins on the day the Customer or a third party other than the carrier and designated by the carrier acquires physical possession of the last good.

10.3. In order to exercise the right of withdrawal, the Customer must inform REVOLUNION SRL of its decision to withdraw from the Purchase Agreement by sending an explicit statement to that effect to the registered office of REVOLUNION SRL or to the e-mail address indicated on the website. For this purpose, the Customer may use, but is not required to, the standard withdrawal form available on the site.

10.4. To comply with the withdrawal period, it is sufficient for the Customer to send the notice regarding the exercise of the right of withdrawal before the expiration of the withdrawal period.

10.5. In the event of withdrawal by the Customer from the Purchase Agreement, all payments made by the Customer in favor of REVOLUNION SRL, including delivery costs (with the exception of additional costs arising from any choice of a type of delivery other than the least expensive type of standard delivery offered), will be refunded without undue delay and in any event no later than 14 days from the day on which REVOLUNION SRL receives the notice of withdrawal. Said refunds will be made using the same means of payment used by the Customer for the initial transaction, unless expressly agreed otherwise; in any case, the Customer shall not incur any costs as a consequence of such a refund. Reimbursement may be suspended until receipt of the Products by REVOLUNION SRL or until Customer demonstrates that it has returned the Products, whichever is earlier.

10.6. The Customer is required to return the Products or deliver them to REVOLUNION SRL at the shipping address indicated on the website without undue delay and in any case within 14 days from the day he/she communicated his/her withdrawal from the Purchase Agreement. The deadline is met if the Customer returns the goods before the expiration of the 14-day period. The cost of returning the Products will be borne by the Customer.

10.7. In accordance with the provisions of Article 59, paragraph 1, letter e), of the Consumer Code (Legislative Decree September 6, 2005, No. 206, as amended), the Customer may not in any case exercise the right of withdrawal in the case of sealed Products that, for reasons of hygiene or health protection, have been opened after delivery.

10.8. Right of withdrawal from the purchase of a Virtual Gift Card. The Customer is granted the right to withdraw from the Purchase Agreement of a Virtual Gift Card, without any penalty, within the term of 14 (fourteen) days from the purchase of the relevant Virtual Gift Card, i.e. from the date of receipt of the Virtual Gift Card activation e-mail. The right of withdrawal set forth in this paragraph shall remain expressly excluded and shall not be exercisable with respect to a partially or fully used Virtual Gift Card. In order to exercise the right of withdrawal, if the above term has not expired and the Virtual Gift Card has not been used, in whole or in part, the Customer is required to inform REVOLUNION SRL of its decision to withdraw from the Purchase Agreement by means of an explicit statement to that effect to be sent to the registered office of REVOLUNION SRL or to the e-mail address indicated on the site. For this purpose, the Customer may use, but is not required to, the standard withdrawal form available on the site. Following the above, the Customer will receive an e-mail confirming the withdrawal and deactivation of the Virtual Gift Card, containing: (i) the order number from which you are withdrawing; (ii) the code of the Virtual Gift Card subject to withdrawal and deactivation – with the last characters obscured in case of purchase of a Virtual Gift Card gifted to a third party; (iii) the expiration date and value of the Virtual Gift Card. In the case of withdrawal exercised with respect to a Virtual Gift Card purchased to give as a gift to a third party, the third party will receive an e-mail informing him or her of the deactivation of the Virtual Gift Card as a result of the Customer’s exercised right of withdrawal. In the event of withdrawal, the Customer will be refunded the payment made for the purchase of the Virtual Gift Card, without undue delay and, in any case, no later than 14 (fourteen) days from the communication of the intention to exercise the right of withdrawal. Said reimbursement will be made using the same means of payment used by the Customer when purchasing the Virtual Gift Card, unless the Customer requests reimbursement on a different means of payment: in the latter case, any additional costs arising from reimbursement through said different means of payment will be borne by the Consumer.

11. Product non-conformity and defective products

11.1. The Products offered on the Site comply with national and EU legislation. The images and colors of the Products posted on the Site may differ from the actual ones due to the local settings of the systems and/or tools used to display them.

11.2. In case of a lack of conformity of the purchased Products with respect to the description published on the Site and in case of a faulty or defective Product, the Customer is entitled to an immediate refund of the non-conforming good, after sending via the form present within the “Customer Service” section of the Site photographs evidencing the damage or non-conformity of the Product.

11.3. This will be followed by a communication from the staff of REVOLUNION SRL indicating the method of reimbursement, which may take place, at the discretion of the Customer, also by means of discount vouchers to be used on a subsequent purchase, excluding any further liability of REVOLUNION SRL, for any reason whatsoever.

11.4. In any case, the provisions on the legal guarantee of conformity of goods, provided for by the Italian Consumer Code (Legislative Decree 206/2005, Part IV, Artt.102-135), are not affected.

12. Processing of personal data

For information on the use of personal data, Customers should refer to the privacy policy of REVOLUNION SRL found in the specially dedicated section within the Site.

13. Communications and complaints

All communications or claims, if any, by the Customer against REVOLUNION SRL with respect to the Purchase Agreements shall be sent through the appropriate means indicated and/or present within the Site in the “Customer Service” section, except as may be provided for in these General Conditions.

14. Intellectual Property Rights

All trademarks (registered and unregistered), as well as any and all intellectual property, distinctive sign or name, image, photograph, written or graphic text and more generally any other intangible asset protected by the laws and international conventions on intellectual property and industrial property, reproduced on the Site remain the exclusive property of REVOLUNION SRL and/or its assignors, without any right deriving to the Customer from access to the Site and/or the App and/or the stipulation of the Purchase Agreements. Any use, even partial, of them is prohibited without the prior written authorization of REVOLUNION SRL, in whose favor all related rights are exclusively reserved.

15. Applicable Law and Jurisdiction

15.1 These General Conditions and any and all Purchase Agreements entered into with the Customer are governed by Italian law.

15.2 Any dispute relating to the interpretation, execution, validity or effectiveness of these General Terms and Conditions and any Purchase Agreement entered into with the Customers shall be competent, the court of the place of residence or domicile of the Customer, if located in Italy.

16. Purchase limits

The Client is hereby made aware and accepts that it shall be the right of REVOLUNION SRL, at its sole discretion to:

Products, services, and promotional samples on the Site are purchased by the Customer for personal use only. The Customer is not permitted to sell or resell any Products, services or promotional samples received. REVOLUNION SRL reserves the right to reduce or terminate any Purchase Agreement if it has reason to believe that the conduct of the Customer may violate the General Conditions.
